You are receiving this letter, as required by Section 3.2.5 of the Durham City-County Unified Development Ordinance (UDO), because you represent an organization which is registered to receive notice pursuant to UDO Section 3.2.5D, Registration to Receive Notice by Mail.
 
Interested parties may appear at the public hearing.  Opponents and proponents of the zoning map change request will be allowed time for presentation and rebuttal.  The City Council will take all comments into consideration before approving or denying the request.  Changes to the proposed zoning map change may be made by the Council following the public hearing.
 
The file for this request may be reviewed Monday through Friday between 8:00 a.m. and 4:30 p.m. at the City-County Planning Department, located on the ground floor of City Hall at 101 City Hall Plaza.  Information on zoning districts and overlays is contained in the UDO, which is available at the Planning Department or via the internet at www.durhamnc.gov/departments/planning /udo/ .  Following also are brief descriptions of the districts and overlays related to this request:
 
PDR (Planned Development Residential) -the PDR district is established to allow for design flexibility in residentail development.  A development plan is required with a request for this district, which shows a conceptual representation of the proposed site that indicates how the ordinance standards could be met.  Any significant change to the development plan would require a new zoning petition.  While PDR is primarily a residential district, other uses may be allowed under limited provisions of the ordinance.
 
RR (Residential Rural) -the RR district in the Rural Tier, watershed area is established to provide for agricultural activities and residential development of lots of at least 30,000 square feet.  The regulations of this district are designed to discourage the development of urban services and to encourage the maintenance of an open and rural character.  Only single-family detached dwellings and manufactured homes shall be permitted. While RR is a residential district, certain nonresidential uses such as day care facilities and places of worship may be sought through a special use permit or other limited provisions of the ordinance.
 
F/J-B (Falls/Jordan District B) Watershed Protection Overlay - The purpose this overlay district is to preserve the quality of the region's drinking water supplies through application of the development standards intended to protect the environment.  In general, water supply protectin will be accomplished by establishing and maintaining low intensity land use and development on land near the region's water supply rivers and reservoirs.  Where high density development is desired, water supply protection will be accomplished through the use of engineered stormwater controls.  The overall objective is to:
 
Property owners may officially protest the proposed zoning map change by filing a protest petition in advance of the hearing.  Protest petition forms are available at the Planning Department, the City Clerk's Office, or via the internet at www.durhamnc.gov/departments/planning/applications .  In general, a petition must be signed by owners of at least 20% of the area included in the proposed change or of at least 5% of a 100-foot wide buffer extending along the area boundary.  Please refer to the form and UDO Section 3.5.13 for specific requirements and procedures.  The petition must be submitted to the City Clerk's Office at least four working days prior to the day of the public hearing. If a valid protest exists, zoning map change approval requires an affirmative vote by three quarters of the City Council rather than the simple majority normally required.
